After a long battle in Kentucky between Hemp growers, the Department of Agriculture, and State Police, Kentucky’s “Boone Circuit Judge Rick Brueggemann declared delta-8 to be a legal derivative of hemp and issued a permanent injunction against law enforcement which prevents them from charging retailers and producers with criminal activity for selling delta-8.” The issues began in April of 2021 when the Kentucky Department of Agriculture sent a letter to Hemp license holders saying that Delta-8 was prohibited under federal law, and law enforcement subsequently began raids on retailers. The Kentucky Hemp Association filed a lawsuit against the state police and the state Department of Agriculture, arguing that the raids were unwarranted and wrong, because Delta-8 is a legal derivative of hemp. On Aug. 3, Judge Rick Brueggemann made it clear in his ruling that Delta-8 is a legal derivative of Hemp and therefore preventing any further intervention by police. Tate Hall, vice president of the Kentucky Hemp Association released a statement saying, “These delta-8 raids on retailers were an obstacle that distracted us from advancing hemp in other ways, but it was a challenge we were ready and willing to face in order to protect retailers of Kentucky Proud Hemp products.” Comments are closed.
