Federal Court Again Rules Against Border Patrol Restricting Cannabis Paraphernalia Imports10/26/2022
U.S. Customs and Border Protection (CBP) in Washington State have attempted to block the import of cannabis trimming equipment into the U.S. On behalf of the Customs & Border Protection Agency, the Department of Justice tried to argue that the trimming equipment should be banned because they would be used for a Schedule I drug under the Controlled Substances Act (CSA). Thankfully, though a federal court has ruled for the second time that the U.S. Customs and Border Protection Agency may not block those imports because it was intended to be shipped to a state that has legalized cannabis and related paraphernalia. The court noted that Federal law allows for an exception to the import and export ban of drug paraphanalia for any person “authorized by local, State, or Federal law to manufacture, possess, or distribute such items.” The court has now made abundantly clear that these types of bans are not legal, as the end state receiving the equipment has authorized it.
