Guns and cannabis don’t really go together. Usually, when police bust someone for a lot of illegal cannabis, having a gun in the same location will make all the difference in how hard they prosecute. Guns onsite at a grow can indicate that there is some highly illegal activity going on, and it is not taken lightly. But most cannabis users don’t have to worry about that. However, if you own a gun, or plan to buy a gun, you should know that according to federal law, any person who uses marijuana (for either recreation or medicinal reasons), even if legal under state law, is prohibited from possessing or purchasing firearms or ammunition. It is also unlawful to sell a firearm or ammunition to any person if the seller knows or has reasonable cause to believe that such person is an unlawful user of marijuana. On 4/20, Nikki Fried, the Florida’s agriculture commissioner and a Democratic candidate for governor, said she “plans to sue the Biden administration Wednesday to try to block [this] federal rule,” according to NBC News, which obtained a copy of her lawsuit. According to NBC, Fried “is bringing the suit with three citizens who have been affected by the federal rules,” and the suit “names the acting head of the Bureau of Alcohol, Tobacco, Firearms and Explosives and Attorney General Merrick Garland as defendants.” Fried sent a tweet on the morning of 4-20 saying, “I’m suing the Biden Administration because people’s rights are being limited. Medical marijuana is legal. Guns are legal. This is about people’s rights and their freedoms to responsibly have both.” Currently, if you try to purchase a gun and check “yes” on the form asking about marijuana use, you will be denied a gun license. Those who lie about it could face up to five years in prison. Fried’s state of Florida has liberal gun laws, and has also allowed legal medical marijuana use since 2016. Fried says she has always supported cannabis reform, and won her race for agriculture commissioner in 2018 on a platform that was dedicated to changing Florida’s cannabis laws. She has ramped up her adult use legalization push in her gubernatorial campaign, which she launched last year. The current governor of Florida, Ron DeSantis, who is also a potential candidate for the 2024 presidential race, has a hard stance against cannabis legalization. Ron DeSantis says of cannabis, “Not while I’m governor. ... When that is introduced with teenagers and young people, I think it has a really detrimental effect to their well being and their maturity.” Both Fried and the other Democratic candidate for governor, Charlie Crist, have pledged to legalize cannabis for adult use if elected.
