New Mexico will be open for legal cannabis business on April 1st, and they have a few interesting rules that other state residents may envy regarding the ‘Who? What? and Where? WHO? Any adult over 21 may purchase cannabis, even out of states residents. This is of particular excitement for the people of Texas where currently only limited medical marijuana is legal. All the other states surrounding Texas: Oklahoma, Arkansas, and Louisiana, also only offer medical marijuana to their residents. But now that New Mexico has fully legal recreational sales, residents of Texas can just drive on over and enjoy! While Texans are not able to legally bring purchases back with them, there will be some cannabis consumption lounges! WHAT? Adults can possess an unlimited amount of cannabis products inside their homes. And any adult, including tourists, can purchase and carry up to 2 ounces on them (outside of the home). WHERE? Cannabis consumption will be treated very much like cigarette or alcohol consumption. For example, it will not be allowed out in public, but it is allowed at licensed consumption lounges, similar to a bar or lounge. Consumption will also be allowed in designated hotels, casinos, cigar and cigarette stores. YAY FOR NEW MEXICO! Overall, the state has been cannabis-friendly with its laws, even stating that cannabis businesses may not be prohibited by any jurisdiction, they cannot be forced to relocate, and transportation of legal cannabis may not be prohibited. And as for taxation: the state has a standard sales tax that ranges from 5-9% depending on location, plus they will levy a 12% excise tax on cannabis that will eventually increases to 18%. Medical marijuana products, available only to patients and caretakers, would be exempt from the tax. New Mexico is sure to see a huge increase in revenue received from Cannabis sales which will definitely benefit it’s residents. In particular, the Eastern side is sure to experience huge growth as the towns along the Texas border are certain to see an influx of visitors and cannabis revenue.
