Yesterday we reported on a New York City law department memo that was leaked on Wednesday, which indicated that marijuana testing would cease for city employees like the Police Department. Shortly after that, the NYPD flip flopped on the issue, first saying they would not drug test, and then saying they would. At least until they spoke in more detail to the law department on the issue, to get clarity. On Thursday afternoon, a union representing firefighters is claiming credit for that leaked memo’s origin. The Uniformed Firefighters Association (UFA) sent a memo to members which referenced the leaked document, and said that it believes the directive is a result of the union inquiring to the city about drug testing policy, in regards to the new Marijuana legalization in the state. While the NYPD decided to hold off on halting drug testing until they get more clarity from the law department, the NYFD did not do the same. The Fire Department stated that they will be making a policy change in light of the city’s legal analysis, but, they did say that specific guidance on what to do won’t be made available for another two weeks. Until that time, the fire department union is urging members to “wait until the Department announced the official changes before considering any legal recreational or medicinal marijuana use.” Both NYPD and NYFD emphasize that they would continue to drug test workers who are suspected of being intoxicated on the job.
